The Department of Homeland Security wants to transition its massive biometric identity management system to more cloud-focused technology. Now, it’s seeking more information from vendors about their biometric capabilities as it tries to pursue that goal.
 

Worldcoin’s Iris-Scanning Orb — Coming to a Delivery App Near You? (Mexico News Daily, Oct 18, 2024)
Mexico’s National Institute for Transparency and Access to Information (INAI) opened an investigation of a project known as Worldcoin, an eye-scanning orb that records biometric data. Now Worldcoin has announced that, starting next year, “the Orb” will be available in Latin America on-demand like a pizza. Wired reported that through a partnership with the app Rappi, citizens will be able to have an Orb show up at their door to scan their irises, allowing them to sign up for the World Network from their own home.
 

String of Numbers or Identifier: The Ninth Circuit Weighs in on BIPA’s Application to Non-Users (JD Supra, Oct 18, 2024)
In June, the U.S. Court of Appeals for the Ninth Circuit affirmed a social media company’s summary judgment win on BIPA claims, in a sophisticated ruling providing a plausible path forward for technology companies and others offering facial matching services. The case involved a social media platform’s “tag suggestion” feature, which would seek to identify other users on the social media platform that appear in an uploaded photo. According to the lawsuit, the feature worked by comparing the faces in the uploaded photos against known photos of the platform’s users.

2024 has seen behavioural advertising and cookies continue to dominate the agenda of data protection authorities (DPAs) in the EU and for the ICO in the UK. Alongside that, DPAs have started to consult about guidance on Artificial Intelligence (AI), particularly Generative AI and Large Language Models (LLMs). After the initial flush of AI enforcement actions in 2023, we have not yet seen clarifying precedent emerge from the DPAs in 2024. We have also seen an increasing focus from DPAs on employee surveillance, particularly use of biometric technologies. We have also seen a sting in the tail of enforcement related to EU-US data transfers, with a major fine issued for breaching GDPR.

As mobile technology continues to evolve, so will the methods used by cybercriminals. In response, identity verification services will need to keep pace, adopting more sophisticated technologies to stay one step ahead. Blockchain technology, for example, holds promise in creating decentralized identity systems that are nearly impossible to hack. Meanwhile, advancements in AI will continue to refine the ability to detect and prevent fraudulent activity in real-time.
